GPA Waiver Policy
A student who, while enrolled at an institution, has experienced sexual misconduct may request a waiver of the minimum required grade point average or disciplinary record requirements required to demonstrate academic success at the University.
This policy has been established in and will be periodically reviewed and updated as necessary to ensure continued compliance with relevant laws and regulations. The Title IX Coordinator will maintain all records of waivers and oversee the implementation of this policy and provide guidance as needed.
Criteria for Waivers
Waivers may be granted when a person has experienced sexual misconduct while enrolled at the University and has received approval from any of the following staff:
- The Title IX Coordinator
- The Title IX Deputy Coordinator
- Survivor Advocate employed by the University
Confidentiality
For individuals that have experienced sexual misconduct and requested a waiver pursuant to the standards identified in this policy, the University shall maintain confidentiality of all materials that contain personally identifiable information for individuals who have requested a waiver under this section unless disclosure is required specifically for the purpose of making required accommodations or if otherwise required by a court of law.
Procedures for Waivers
Upon receiving a waiver request, the recipient will consult with relevant campus partners to evaluate the request and develop a comprehensive success plan for the student. The recipient will then meet with the student to review the plan, confirm the student’s understanding, and ensure agreement to support their continued success in the program for which the waiver is sought.
A student must complete a separate waiver process for each institution-sponsored program or activity for which a waiver is requested.
All waiver decisions, including the rationale, will be communicated to the student in writing. Documentation provided to the student or to the office administering the program or activity will indicate that the waiver is granted in compliance with ORS 350.344 and will not include the specific reason for the waiver.
All final waiver records will be maintained by the Title IX Coordinator.
Programs Eligible for Waiver
Institution-sponsored programs or activities include academic or extracurricular programs that the University maintains authority over. This includes, but is not limited:
- A scholarship provided by the University
- Student employment and leadership opportunities (e.g.: Resident Assistant, Student Government, other student employment opportunities)
- Academic programs that the University exercises full control over
Programs that the University cannot maintain control over are not eligible for a waiver. Programs may include:
- NCAA National Eligibility Standards
- Fraternity and Sorority organizations’ national standards
- Academic programs that have state-required examinations or standards (e.g.: Nursing Program, Teacher Education)
